5 Year Service Life Guarantee
Chart Fencing and Sheds (a trading name of “Chart Stables Ltd”) was established in 1994 and is a market leader in designing and manufacturing high quality timber sectional buildings. Customer service is at the heart of what we do.
The Chart Sheds 5 Year Guarantee (the “Guarantee”) gives you confidence and trust that your shed (the “Product”) will be serviceable for 5 years (the “Guarantee Period”), subject to normal maintenance and proper use.
When does the Guarantee Period commence?
The Guarantee Period commences from the date the Product was delivered to the agreed delivery site.
What is covered by the Guarantee?
The Guarantee will cover you for any defects in craftsmanship or workmanship that occur during the manufacture and/or installation process of the Product or Product base (exclusions below apply).
What areas aren’t covered by the Guarantee?
We cannot accept responsibility for or cover problems resulting but not limited to the following:
- Normal wear and tear of the Products; • Incorrect fitting or installation of the Product or Product base in contravention of Chart Stables Ltd’s fixing and maintenance instructions, available at the time of purchase;
- If there has been unauthorised modification of the Product, including damage (accidental or wilful), Chart Stables Ltd accepts no responsibility for malfunction; • Neglect and misuse of the Product including, but not limited to, poor upkeep and maintenance of the Product. We recommend regular and appropriate cleaning of Product (including the roof and any guttering) to keep them free of dirt as well as lubrication of moving part (including hinges to doors and windows); and
- External events including (but not limited to) environmental issues such as flooding and storm damage, accidental damage, forced entry, vandalism, salt corrosion and civil unrest.
- Roofing including felt. Our sheds come with a variety of roofing options, these are considered as wear and tear item and will have a life span dependent upon your choice of roofing.
If the purchase has been validated within the terms stated and the defect has occurred during the Guarantee Period, and is within the scope of the Guarantee, Chart Stables Ltd will repair or replace the Product, at our discretion. If the Product is no longer available, we will offer our nearest current equivalent product.
What costs are not covered?
- Costs relating to routine maintenance and care of the Product fall outside of the range and protection of this Guarantee.
- Where damage has been caused to the Product by actions including but not limited to vehicle impact, acts of vandalism, forced entry or other unforeseen acts not associated with the normal use of the Product, the Guarantee on the part of the Product affected will be invalid.
- Our liability is limited to the Product supplied by us and does not extend to any consequential loss or damage arising from the Product being defective. We will not cover you for related costs or expenses arising from the defect such as hire of temporary replacement products, loss of use, loss of business earnings, time or aggravation.
- Contact the Chart Stables Ltd office to report your fault and initiate your claim against the Guarantee as soon as possible upon becoming aware of the existence of the defect.
- The team will ask you to supply photos and/or videos of the defects to support your claim.
- The team will be in touch within two business days. In our reasonable opinion, if the Product is defective due to the manufacture and/or installation and that the conditions in this Guarantee have been met, we will arrange for a member of our team to inspect the Product in its installed condition as soon as reasonably practicable.
- You will need to provide evidence of regular and planned inspection, care and upkeep for the Product.
- Any work under the Guarantee must be carried out by Chart Stables Ltd or a repairer appointed by us who will carry out the repair in accordance with our standards, at our cost. Once the repair has been completed, we will remove any defective or faulty items from the Product and these will become the property of Chart Stables Ltd.
- Should we carry out work as a result of a claim but then discover that the Product has not be cared for or used in accordance with our terms, we reserve the right to charge you for any expense we incur. What if my Product develops a problem after the Guarantee Period? We’re always happy to help assess and, where possible, repair any problems with our Products when they fall outside of the Guarantee Period, so please don’t hesitate to get in touch and tell us what the problem is.
Other important terms
- This Guarantee is only valid for products supplied and delivered in the UK.
- Chart Stables Ltd may transfer this Guarantee to someone else. Chart Stables may transfer its rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the Guarantee.
- The Guarantee applies to the original purchaser only and is non-transferable unless agreed in writing with Chart Fencing and Sheds. • Chart Stables Ltd reserves the right to modify or amend these Guarantee terms without notice.
- The terms of this Guarantee are in addition to your statutory rights as a consumer under your contract of sale.
- If a court finds part of this Guarantee illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
- Nobody else has any rights under this Guarantee. The Guarantee is between you and Chart Stables Ltd. No other person shall have any rights to enforce any of its terms.
- The terms of this Guarantee are in addition to our standard Terms of Business.
